Terms of Service

The terms governing use of the SAIESA platform.

Welcome to the official member platform of the St. Andrew's Institute Ex-Students' Association ("SAIESA", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of saiesa.org, including our member directory, forums, chat features, job postings, and event registrations.

1. Acceptance of Terms

By accessing, registering on, or using this platform, you agree to be bound by these Terms, our Privacy Policy, and our Constitution/Bylaws. If you do not agree to these Terms, you must immediately refrain from registering or using authenticated member areas.

2. Membership Eligibility & Verification

  • Eligibility: Membership is strictly intended for bona fide alumni, former faculty, and authorized current students of St. Andrew's Institute, Vasco da Gama, Goa, who are at least eighteen (18) years of age.
  • Approval Discretion: Account registration does not confer automatic membership. All accounts are subject to administrative verification and approval by the SAIESA Managing Committee. SAIESA reserves the absolute discretion to reject, suspend, or revoke membership if academic affiliation cannot be established or for breach of these Terms.

3. Account Responsibilities & Security

  • You must provide truthful, accurate, and current information during registration.
  • You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
  • Sharing account credentials, creating duplicate accounts, or registering on behalf of another individual without verified authority is strictly prohibited.
  • You agree to notify SAIESA immediately at saiesa2025@gmail.com upon discovering any unauthorized access or breach of security.

4. Acceptable Use & Statutory Intermediary Compliance

As an intermediary platform governed by Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, SAIESA strictly prohibits the hosting, displaying, uploading, modifying, publishing, or sharing of any content that:

  • Belongs to another person and to which you do not have a lawful right;
  • Is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, insulting, or harassing on the basis of gender, race, or religion;
  • Is harmful to minors in any way;
  • Infringes any patent, trademark, copyright, or other proprietary rights;
  • Violates any law for the time being in force;
  • Deceives or misleads the addressee about the origin of the message or deliberately communicates misinformation;
  • Impersonates another person or misrepresents your batch, class, or institutional affiliation;
  • Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign States, or public order;
  • Contains software viruses, malware, or code designed to interrupt, destroy, or limit the functionality of computer resources;
  • Involves automated scraping, mining, or harvesting of alumni contact details or personal directories.

5. Intellectual Property & License to SAIESA

  • User Content: You retain ownership of all intellectual property rights in the content, posts, discussions, and materials you publish on the platform.
  • License Grant: By submitting content, you grant SAIESA a non-exclusive, royalty-free, worldwide license to host, display, store, format, and distribute your content across the platform solely to administer the community and deliver platform services.
  • Storage Limits: Accounts are subject to fair-use storage quotas for media attachments (presently 5 MB per member, configurable by SAIESA). Files exceeding this threshold may be rejected or removed.

6. Content Moderation & Account Sanctions

In accordance with statutory obligations and community preservation, SAIESA administrators reserve the right to review, moderate, remove, or disable access to any content that violates these Terms. The Managing Committee reserves the right to issue warnings, suspend privileges, or permanently terminate accounts of repeat or gross violators without prior notice.

7. Private Communications & Chat Channels

Chat channels and interest groups are invite-only and intended for fellowship and collaborative alumni initiatives. While communications within private channels are restricted to participating members, SAIESA administrators maintain technical audit access for administrative enforcement, security, and the investigation of reported harassment or illegal conduct.

8. Financial Contributions & Voluntary Donations

  • Voluntary donations made through saiesa.org to the association (Regn. No. 18/GOA/2025) are non-commercial contributions made solely to advance the society's non-profit objectives.
  • Contributions are non-refundable except under specific circumstances outlined in our separate Donation Refund Policy.
  • Payment processing is conducted through authorized payment aggregators (e.g., Razorpay/Cashfree). SAIESA does not collect or store credit/debit card numbers, CVVs, or internet banking credentials on its servers.

9. Service Availability

The platform is provided on an "as is" and "as available" basis. As a volunteer-run alumni society, SAIESA does not warrant uninterrupted, error-free, or fully secure operations, and reserves the right to modify, suspend, or discontinue components of the service without liability.

10. Disclaimer & Limitation of Liability

To the maximum extent permitted by applicable Indian law:

  • SAIESA, its Managing Committee, office bearers, and volunteers disclaim all warranties, express or implied, regarding site accuracy, uptime, or the reliability of job listings and user-submitted postings.
  • In no event shall SAIESA or its committee members be liable for any indirect, incidental, punitive, or consequential damages arising from the use of or inability to use the platform.

11. Indemnity

You agree to defend, indemnify, and hold harmless SAIESA, its Managing Committee members, administrators, and authorized representatives from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms;
  • Any content, media, or comments you submit to the platform; or
  • Your infringement of any third-party rights, including intellectual property or privacy rights.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, proceeding, or litigation arising out of or in connection with these Terms or the platform shall be subject to the exclusive jurisdiction of the competent courts in South Goa (Vasco da Gama / Margao), India.

13. Modifications to Terms

SAIESA reserves the right to revise these Terms to reflect legislative changes, platform upgrades, or administrative updates. Continued use of the platform following notification or posting of updated Terms constitutes full acceptance.

Grievances submitted regarding content violations, safety concerns, or account disputes will be acknowledged within forty-eight (48) hours and addressed in accordance with statutory guidelines.
